These Terms govern your access to and use of Finoa, a personal budgeting and financial tracking service operated in New Zealand ("we", "us", or "Finoa"). By creating an account or using Finoa, you agree to these Terms.
Eligibility
Finoa is intended primarily for New Zealand residents. By using Finoa, you confirm that you:
- Are at least 18 years of age
- Are using the service for personal, non-commercial purposes
- Have the legal capacity to enter into a binding agreement
Description of Service
Finoa provides personal budgeting tools including transaction categorisation, spending analysis, and budget tracking.
Nature of Financial Information
Important: Finoa is a budgeting tool only. Nothing in the service constitutes financial advice under the Financial Markets Conduct Act 2013. Consult a licensed financial adviser before making financial decisions.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. You must provide accurate information and notify us immediately of any unauthorised access.
Acceptable Use
You agree not to use Finoa to violate any New Zealand law, attempt unauthorised access, reverse engineer the software, transmit malicious code, or use the service for any commercial purpose.
Data and Privacy
Our Privacy Policy forms part of these Terms and sets out how we collect, use, store, and protect your personal information under the Privacy Act 2020 (NZ). We do not sell your personal data.
Limitation of Liability
To the maximum extent permitted by New Zealand law, Finoa's total liability is limited to NZD $50.
Finoa is not liable for financial decisions made in reliance on information displayed in the service or CSV import inaccuracies. Nothing in these Terms limits rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986.
Intellectual Property
All intellectual property in the Finoa platform is owned by or licensed to Finoa. You are granted a limited, non-exclusive, non-transferable licence to use the service for personal use only.
Third-Party Services
Finoa integrates with and Cloudflare (infrastructure). Your use of these integrations is also subject to their respective terms and privacy policies. Finoa is not responsible for the acts or omissions of these providers.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the service constitutes acceptance.
Termination
We reserve the right to suspend or terminate your access if you breach these Terms. Upon termination you may request an export of your data. We retain data for up to 90 days then delete it unless required by law.
Governing Law
These Terms are governed by the laws of New Zealand. Disputes are subject to the exclusive jurisdiction of the New Zealand courts. The Disputes Tribunal provides an accessible forum for smaller claims up to $30,000 in value, though any award remains subject to the liability limits in Section 07.
